Terms of service

These terms are a contract between you and ClaimsPro (“we”, “us”), the operator of the service at claimspro.app, governing your use of that service. By creating an account or using the service, you agree to them. Please read them; they are short and written to be understood.

1. What ClaimsPro is, and is not

ClaimsPro is software for documenting the contents portion of a property insurance claim. It helps you build an inventory of personal property, value items at replacement cost (RCV) and actual cash value (ACV), attach evidence such as receipts, purchase records, and market comparables, and produce an organized claim package.

  • ClaimsPro is not an insurance company, an insurance intermediary, a public adjusting firm, an appraiser, or a law firm. Nothing in the service is insurance, legal, tax, or financial advice.
  • Valuations produced or suggested by the service, including RCV and ACV figures and market comparables, are estimates to support your claim preparation. They are not appraisals and they do not bind any insurer. Your insurer decides what it pays under your policy.
  • You are responsible for the accuracy and completeness of anything you submit to an insurer, whether or not it was prepared with ClaimsPro.

2. Your account

You sign in with Google or an emailed sign-in link. You must provide accurate account information, be at least 18 years old, and keep control of the email account you use to sign in. You are responsible for activity under your account. Tell us promptly at security@claimspro.app if you believe your account has been compromised.

3. Households, teams, and invited access

ClaimsPro lets you invite other people into your household workspace with defined roles, for example family members, a public adjuster, an insurance adjuster, or a contractor. Public adjusters can operate a firm workspace that manages client households.

  • When you invite someone, you decide their role and what that role can see and do. Only invite people you trust with your claim information.
  • If you join a workspace you do not own, you may only use the information in it for the purpose the owner invited you for, such as adjusting or rebuilding work on that claim.
  • Professionals using ClaimsPro with clients are responsible for their own licensing, regulatory, and contractual obligations, including public adjuster licensing rules in their state.

4. Your content and our license to operate on it

Your inventory, photos, receipts, documents, messages, and everything else you add to ClaimsPro is yours. You grant us the limited license needed to host, process, back up, and display that content to you and to the people you invite, and to operate features you use on it, such as document text extraction and valuation suggestions. We do not sell your content and we do not use it to advertise to you.

You can export your data from the service, and you can request deletion as described in the privacy policy.

5. Honest use

ClaimsPro exists to substantiate real losses with real evidence. You agree not to use it to prepare, support, or submit a false or inflated insurance claim, to fabricate or alter evidence, or to misrepresent ownership or value. Insurance fraud is a crime in every U.S. state. We may suspend or terminate accounts we reasonably believe are being used dishonestly, and we may cooperate with lawful requests from authorities.

You also agree not to:

  • break, probe, or overload the service or access data that is not yours;
  • upload malware or unlawful content;
  • resell or white-label the service without a written agreement with us;
  • use automated scraping against the service, other than search engines honoring robots.txt.

6. Fees

Parts of ClaimsPro may be free and parts may be paid. Current pricing, if any applies to you, is presented before you commit to a purchase. We will give you reasonable notice of pricing changes that affect you.

7. Service changes and availability

We improve the service continuously and may add, change, or remove features. We aim for high availability but the service is provided without an uptime guarantee. Where a change materially reduces core functionality you rely on, we will make export of your data available as described above.

8. Disclaimers

The service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that valuations, extracted document data, or suggested comparables are accurate or complete, or that use of the service will produce any particular claim outcome.

9. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, and our total liability for all claims arising out of the service is limited to the greater of the amounts you paid us in the twelve months before the claim arose or one hundred U.S. dollars. Nothing in these terms limits liability that cannot be limited by law.

10. Indemnity

You will indemnify us against third-party claims arising from your content, your use of the service in violation of these terms, or your submission of any claim to an insurer, except to the extent caused by our breach of these terms.

11. Termination

You can stop using ClaimsPro and delete your account at any time. We may suspend or terminate access for material breach of these terms, including dishonest use under section 5. After termination we retain and delete data as described in the privacy policy, and we will provide a reasonable window to export your data unless the law or fraud prevention requires otherwise.

12. Governing law and disputes

These terms are governed by United States law and the law of the state in which ClaimsPro is organized, without regard to conflict of laws rules. Before filing any claim, you agree to contact us at legal@claimspro.app and give us thirty days to work it out with you.

13. Changes to these terms

If we make material changes, we will notify you by email or in the product at least fourteen days before they take effect. Continued use after the effective date means you accept the updated terms.
